These Terms of Service (“Terms”) govern the use of services provided by Orion Artistic (“we”, “us”, “our”). By booking our services or using our website, you (“Client”, “you”) agree to these Terms.
1. Services
Orion Artistic provides photography, videography, and related creative services. The scope of work will be agreed upon with each client before a project begins.
2. Booking and Payment
- Bookings are confirmed once a deposit or signed agreement has been received (if applicable).
- Full payment terms will be provided in writing before the project begins.
- Deposits are non-refundable unless agreed otherwise.
3. Use of Client Materials
- By working with Orion Artistic, you grant us the right to use selected images, videos, or creative content from your project for portfolio, marketing, and promotional purposes, including but not limited to our website, social media, and advertising.
- If you require your project to remain confidential, you must notify us in writing before the project begins. In such cases, we will respect your request and will not use your materials publicly.
4. Delivery of Work
- Final deliverables will be shared through secure platforms such as Google Drive.
- We will make reasonable efforts to meet agreed deadlines, but delivery times may vary depending on project complexity and circumstances beyond our control.
5. Intellectual Property
- Orion Artistic retains the copyright and creative rights to all works produced unless otherwise agreed in writing.
- Clients are granted a license to use the final deliverables for personal or commercial purposes, depending on the agreement made before the project begins.
- Raw or unedited files remain the property of Orion Artistic and are not provided unless explicitly agreed.
6. Client Responsibilities
- Clients must provide accurate information and necessary cooperation for the successful completion of a project.
- Clients are responsible for securing permissions or releases required for filming or photography at certain locations or involving third parties (unless agreed otherwise).
7. Limitation of Liability
- While we take every precaution to safeguard client work, Orion Artistic is not liable for unforeseen events such as technical failures, data corruption, or circumstances beyond our control.
- In no event shall our liability exceed the total amount paid by the client for the specific project.
8. Termination
- Either party may terminate a project in writing.
- If a project is terminated by the client after work has begun, the client remains responsible for payment of any completed work or costs incurred.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Zimbabwe. Any disputes shall be subject to the exclusive jurisdiction of the courts of that region.
